By using the Janxy Dispatch website, you acknowledge the following.

1. No Guarantee of Loads, Rates, or Earnings

Janxy Dispatch does not guarantee any particular number of loads, freight rate, rate per mile, gross revenue, profit, weekly or monthly income, lane, destination, or other business result.

The freight market changes continuously. Load availability and rates may be affected by location, equipment type, market demand, seasonality, timing, carrier authority, safety history, broker requirements, economic conditions, weather, fuel conditions, and other factors outside Janxy Dispatch's control.

Any rates, loads, revenue figures, examples, estimates, projections, or potential opportunities discussed or displayed by Janxy Dispatch are provided for informational purposes and are not guarantees of future results.

A potential load is not considered secured merely because it has been identified or discussed.

2. Carrier Retains Control and Responsibility

Motor carriers remain independent businesses and retain ultimate control over their operations.

The carrier retains responsibility for deciding whether to accept or reject loads and for communicating its operating preferences, including desired lanes, rates, schedules, equipment requirements, and other restrictions.

Carriers and their drivers remain solely responsible for the lawful and safe operation of their vehicles, including operating authority, insurance, driver qualifications, equipment condition, hours-of-service compliance, routing, cargo requirements, safety decisions, and all other obligations applicable to their transportation operations.

No load, appointment, rate, customer request, or communication from Janxy Dispatch should ever be interpreted as requiring a carrier or driver to violate applicable law or operate unsafely.

3. Nature of Janxy Dispatch Services

Janxy Dispatch provides remote dispatch-related services to motor carriers.

Janxy Dispatch does not transport freight, take possession or custody of cargo, or represent itself as a motor carrier.

When formally engaged by a carrier, Janxy Dispatch intends to provide dispatch-related assistance on behalf of and subject to the authorization and direction of that carrier under the applicable Carrier–Dispatcher Agreement.

Janxy Dispatch does not represent that it holds freight-broker authority or any governmental authority that it does not in fact hold. The legal classification of transportation-related activities depends on the activities actually performed and applicable law.

Nothing on this website authorizes Janxy Dispatch or a customer to engage in activity requiring a license, registration, authority, bond, insurance, or other regulatory approval unless the applicable requirements have been satisfied.

4. Third Parties

Janxy Dispatch may interact with or provide information concerning independent third parties, including freight brokers, shippers, receivers, load boards, factoring companies, payment providers, and other transportation-industry participants.

Unless expressly stated otherwise, these parties are independent from Janxy Dispatch.

Janxy Dispatch does not control or guarantee their conduct, payment, creditworthiness, availability, rates, facilities, loading or unloading times, documentation, technology, performance, or compliance with their obligations.

Information received from third parties may also change or contain errors. Carriers should review material load and business information before making operational or financial decisions.

5. Free Trial and Pricing

Where offered and confirmed, Janxy Dispatch may provide an introductory seven-day free trial during which qualifying dispatch services are provided without the standard dispatch-service percentage fee.

The free trial does not guarantee loads, rates, revenue, profit, or any other business result, and Janxy Dispatch does not pay the carrier's operating or third-party expenses.

Unless otherwise agreed, Janxy Dispatch's standard dispatch-service fee is 8% of the applicable agreed load amount. A different fee may be mutually negotiated and agreed upon between Janxy Dispatch and the carrier.

Specific pricing, payment, trial, and service terms may be further defined in the applicable Carrier–Dispatcher Agreement.

6. No Professional Advice

Information provided by Janxy Dispatch does not constitute legal, tax, accounting, investment, insurance, or financial advice.

Transportation laws, regulations, contracts, insurance requirements, tax obligations, and business circumstances vary. Carriers should obtain advice from appropriately qualified professionals where necessary.

7. Website Information and Examples

Janxy Dispatch attempts to keep website information reasonably accurate and current but does not guarantee that all information will always be complete, current, uninterrupted, or error-free.

Any testimonials, historical results, sample loads, rate examples, case examples, or other performance-related information describe particular circumstances and should not be interpreted as a promise that another carrier will obtain identical or similar results.

Accessing this website, submitting an inquiry, or communicating with Janxy Dispatch does not by itself establish a carrier-dispatcher relationship.

8. Carrier–Dispatcher Agreement

Actual dispatch services are subject to the applicable Carrier–Dispatcher Agreement and any other written terms agreed between Janxy Dispatch and the carrier.

That agreement may address matters including authorization, scope of services, fees, payment, carrier responsibilities, termination, liability, dispute resolution, and governing law.

If this general website Disclaimer directly conflicts with an executed Carrier–Dispatcher Agreement regarding an active dispatch relationship, the Carrier–Dispatcher Agreement controls with respect to that relationship to the extent of the conflict.

9. Limitation and Applicable Law

To the maximum extent permitted by applicable law, users are responsible for exercising reasonable independent judgment when making business and transportation decisions.

Nothing in this Disclaimer is intended to exclude, waive, or limit any right, obligation, or liability that cannot lawfully be excluded, waived, or limited.

This Disclaimer should be read together with the Janxy Dispatch Terms of Service and Privacy Policy.
